Terms of use

These Terms of Use (the “Terms”) govern your use of the game My Gym Empire (the “Game”) on iPhone/iPad (App Store) and Android (Google Play). By downloading, installing or playing the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Game.

1. Who we are

In these Terms, “we”, “us” and “our” refer to Ninja Block Studios, and “you” refers to the person using the Game.

2. Who can play

The Game is intended for people aged 13 and over, in line with the age rating shown in the store.
If you are under 18 (or the age of majority where you live), use the Game with the knowledge of your parent or guardian. Purchases may only be made by them or with their permission. Apple and Google offer parental controls to block or approve purchases.

3. License to use the Game

We grant you a personal, non-exclusive, non-transferable, revocable and non-commercial license to install and play the Game on devices you control, in accordance with these Terms and the rules of the store you downloaded it from.

You may not:

copy, modify, decompile, reverse engineer or attempt to extract the Game’s source code, except where the law expressly allows it;
use cheats, bots, third-party programs or mods, or alter the Game’s files, to gain advantages, items or currency;
intentionally exploit bugs to gain an advantage;
sell, rent, sublicense or distribute the Game, accounts, items or virtual currency;
use the Game for any unlawful purpose.

4. Intellectual property

The Game and all its content (characters, names, trademarks, art, 3D models, music, sounds, text and code) belong to Ninja Block Studios or its licensors and are protected by copyright and intellectual property laws. These Terms do not transfer any ownership rights to you.

You may record videos and stream the Game for non-commercial purposes or for content creation (such as videos and livestreams), as long as you do not suggest that it is official content from us.

5. Virtual currency and items

The Game includes virtual currency and items such as in-game money, diamonds, protein, equipment, cosmetics and boosts.

They can be used only within the Game, have no real-world monetary value, are not money or your property, and cannot be exchanged for cash, transferred to others or sold.
What you obtain is a limited license to use these items in the Game while the Game is available.
We may adjust prices, amounts, effects and game balance (for example, to fix bugs or keep the Game fair and fun), while respecting what you have already bought with real money.

6. Purchases and subscriptions

The Game is free to download and may offer optional real-money purchases, such as “No Ads”, diamond packs, special offers, season passes and subscriptions (for example, a VIP club).

All payments are processed by Apple (App Store) or Google (Google Play) under their rules and policies. We do not receive your card details.
Prices are shown in the store before you buy, including applicable taxes.
Subscriptions renew automatically for the same period until you cancel. You cancel in your Apple or Google account settings, and cancellation takes effect at the next period; the period already paid remains active until it ends.
Refunds are handled by Apple or Google under each store’s policies. This does not affect any rights you have as a consumer under the law of your country.
Purchased items are saved on your device. Permanent purchases (such as “No Ads”) can be restored with the “Restore purchases” option using the same Apple or Google account. Consumable items (such as diamonds) that have been used, or that were lost by deleting your progress, cannot be restored.

7. Ads

The Game may show ads, including rewarded ads that you choose to watch in exchange for an in-game reward. Watching them is always optional. Third-party ads are the responsibility of the advertiser; we do not endorse the products advertised. How ad data is handled is explained in the Privacy Policy.

Signing in with Game Center, Google Play Games, Apple or Google is optional. Without signing in, your progress is stored only on your device. When signed in, where available, your progress and purchases can be saved and restored on another device. Without signing in, if you uninstall the Game, clear the app’s data, use “Delete progress”, switch devices without a backup, or your device is lost or damaged, your progress may be lost and we cannot recover it. Your system backup (iCloud or Google) may help, depending on your account settings.

9. Updates and availability

We may release updates that change, add or remove content and features. Some updates may be required to keep playing. We do not guarantee that the Game will always be available, error-free or compatible with every device. We may discontinue the Game; if that happens, we will give reasonable notice whenever possible, and it will not affect the rights the law gives you.

10. Liability

The Game is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect damages, lost profits or loss of progress caused by factors outside our control (such as failures of your device, operating system or the app stores).

Nothing in these Terms limits the rights you have under mandatory consumer protection laws, including Brazil’s Consumer Defense Code.

11. Suspension

If you breach these Terms (for example, by cheating or modifying the Game), we may restrict access to features or to items obtained improperly, in addition to any other remedies available under the law.

12. App store terms

If you downloaded the Game from the App Store, Apple’s Licensed Application End User License Agreement also applies. Apple is not responsible for the Game or for providing support for it. If you downloaded it from Google Play, the Google Play Terms of Service also apply. In case of conflict, whichever is more favorable to you applies, to the extent permitted by law.

13. Changes to these Terms

We may update these Terms when the Game changes or when the law requires it. The latest version is always available at https://www.ninjastudios.gg/en/mobile/my-gym-empire/terms, with the “Last updated” date at the top. If a change is significant, we will let you know in the Game. Continuing to play after the notice means you accept the new version.

14. Governing law and contact

These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer, you may bring claims in the courts of your place of residence, as provided by consumer protection law.
